good morning i'm kristen sze, thanks for joining us. eric thomas is off this morning. we begin with the deadly theater shootings. the man accused makes his first court appearance a few hours from now, 12 killed, 58 injured. rebecca stevens has more from aurora, colorado. >> reporter: holmes won't be charged today prosecutors have three days to file the charges at least 71, one for each victim and probably more. 12 died and several others were hospitalized in critical condition when the gunman opened fire in a crowded movie

theater, showing the latest batman movie. holmes could face a competency evaluation. meanwhile, for the first time seeing and hearing the suspect james holmes in exclusive video obtained by abc news. it is holmes, just after his high school graduation making a presentation at science camp. >> super power and let 'em have more fun. >> reporter: the suspect is not cooperating with authorities and is in solitary. last night the people of aurora heard first from president obama who spent more than two hours with the victims and their families. >> the president: i confessed to them that words are always inadequate in these kinds of situations. >> reporter: then from leaders of their community. >> one day lord, we know that our city will march back into

that theater and we'll claim that theater back father god because it doesn't belong to terrorists it belongs to the city of aurora. >> reporter: president obama and mitt romney vowed they will not run campaign shots in colorado until further notice that includes both spots from their own campaigns and the super pacs. rebecca stevens, abc news. abc news has obtained video of the suspect james holmes recorded six years ago when he was speaking at a science camp. >> let 'em have more fun. >> you saw that in rebecca's story. abc news took to the video to a psychologist to get a professional opinion on what the video reveals about holmes. >> a very bright person, articulate, organized in his thoughts, very smart. >> he also said evidence

indicates holmes didn't just snap, careful planning and precise execution shows a proactive attack behavior or premeditation. >> for many american the tragedy in colorado reignited the debate about guns and how they can be kept from falling into the wrong hands. investigators said holmes bought all weapons and ammunition legally. >> we've got to sit down and come to grips with what is sold to the average citizen in america. i have no problem with people being licensed, buying a firearm. but these are weapons that you're only going to be using to kill people in close come battle >> you can't stop selling guns. if you are going to be in an armed country you have to deal with occasional fruit loops, that's the way it goes. >> senator feinstein echoed the words of many by pointing out both president obama and

telegraph and san pablo avenues will be closed all day from 17th street to 20th street. several side streets will be closed from broadway to san pablo. the 17th street entrance to the 19th street bart station will be closed. ac transit will reroute from 11 this morning until 11 tonight. mitt romney will leave the bay area later today he arrived in san francisco yesterday attending three fundraising events he attended a reception at the fairmont hotel which brought out protesters. earlier he had lunch at a woodside home where supporters each forked over $50 now. last night a dinner at a pacific heights home in san francisco. man accused of kidnapping and murdering sierra lamar waits trial.

his father is due in court to answer to sex crimes, prosecutors say against a 15-year-old girl. in may the public defender for antolin garcia-torres had to step down because of an undisclosed conflict of interest. abc7 news acquired documents showing garcia-torres's father faces sex charges his father's victim came forward and told detective of 10 years of an us what -- 10 of abuse. fundraiser was health in concord for the survivor of a crash that took the lies of her sister and dad in april, 9-year-old and her father were out biking when they were struck and killed by an suv driven by a teenager. hanna was with them but survived. organizers tell us he worked hard for his family. >> [ inaudible ]

good morning. a san diego teenager is in the hospital with possible internal injuries after a cliff diving accident. two boys were jumping off the sunset cliffs in the ocean the first made night the water okay. the second boy landed right on top of him, his friends pulled on to a nearby rock ledge where he was reached by rescue crews he wasn't able to climb out on his own because he was having trouble breathing he's expected to be okay. in orange county two police officers on paid leave after they shot and killed and armed man saturday night. look at what happened next. an angry crowd of witnesses set fires to garbage bins and threw bottles at police. several arrests were may. protesters stormed the police station yesterday. five people were arrested there. the shooting remains under
